How the format works: Drop/stress-test Reel.

UK check: CAP 3.1, 3.7 and 3.11. Show only the height, surface and phone model you tested, and check internal function, not just the glass. A disclaimer doesn't rescue an exaggerated impression. In HTC Europe (Facebook, 4 April 2018, CAP rules 3.1, 3.9 and 3.11):

"We noted that the on-screen text stated "Don't try this stunt, Tom's a professional". However, we considered that this related to diving from the diving board, rather than to the use of the phone while diving, and therefore the qualification was insufficient to counteract the impression created by the ad that the phone could be used in that way."

Funnel: top/mid. Test: do you hold a report matching the height, surface, phone model and function checks you show? The example above states its height and surface on screen; the dropped phone is labelled as the previous model.

What the ASA's Mous ruling says

The ASA upheld a complaint against Mous Products Ltd on 3 April 2024 about a TV ad, seen on 15 October 2023, showing people throwing their phones in Mous cases.

The Mous ruling was about a TV ad under the broadcast (BCAP) Code. Meta ads fall under the non-broadcast CAP Code, whose equivalent rules are 3.1, 3.7 and 3.11.

On drop height:

"However, we noted that the height of the drop tests was significantly lower than had been shown in the ad, and as such, regardless of any results demonstrating that the cases had prevented damage from occurring, we did not consider the reports were sufficient to substantiate that the cases could protect a phone from falls that were higher than 120cm."

On internal damage: "Because the test did not assess for internal damage we did not consider that the data provided sufficient evidence to demonstrate that the phones had not been significantly damaged when dropped from being thrown into the air."

On independence: "We considered that, because of the participants involved and their association with Mous, that the test was not conducted independently and the footage shown in the ad did not represent an objective study of any damage incurred."

On the scenario: "Furthermore, because the ad demonstrated an unrealistic scenario of several phones being thrown into the air, we considered the ad implied that, by using a Mous phone case, any phone would be able to sustain more of an impact than a consumer would likely need."

The outcome: "The ad breached BCAP rules 3.1 (Misleading advertising), 3.9 (Substantiation) and 3.12 (Exaggeration)."

UK check: name exact models and never imply "fits all"; leaving out a significant limitation, such as a model the case doesn't fit, can mislead (CAP 3.1 and 3.9).

Apple's terms, not ASA rules: Apple's trademark guidelines allow compatibility references where "b. The Apple word mark is used in a referential phrase such as “runs on,” “for use with,” “for,” or “compatible with.”", "d. The product is in fact compatible with, or otherwise works with, the referenced Apple product." and "e. The reference to Apple does not create a sense of endorsement, sponsorship, or false association with Apple or Apple products or services." No Apple logo.

How the format works: MagSafe snap-and-hold.

UK check: any pull-force, "never falls off" or charging claim needs evidence under CAP 3.7, and the demo should reflect realistic use (CAP 3.11). We found no ASA ruling on magnet strength or "military-grade" claims, so treat both as evidence questions.

The ASA's evidence guidance (8 June 2017): "However, submitting a copy of an industry test certificate alone might not be sufficient to substantiate an efficacy claim, particularly if the complainant has submitted evidence to indicate that the product might not meet the test standard (ESR Enterprise Ltd)."

Wording: "MagSafe" is on Apple's trademark list. Say "compatible with MagSafe" only where true, and don't imply Apple certification unless you hold it.

UK check: protection lines in a creator's script are still your objective claims, so they need evidence under CAP 3.7. Hold proof that testimonials are genuine (CAP 3.47), and make paid creator content obviously an ad.

UK check: the comparison rules sit in CAP section 3:

Identifiable competitor: 3.32–3.36 ("Comparisons with identifiable competitors"; 3.36 covers protected designations of origin). Same purpose, objective and representative features, no confusion.

Unidentifiable competitor: 3.37, under "Other comparisons".

Price comparison: 3.38–3.39.

Denigration: 3.41, under "Imitation and denigration".

CAP 3.37: "Marketing communications that include a comparison with an unidentifiable competitor must not mislead, or be likely to mislead, the consumer. The elements of the comparison must not be selected to give the marketer an unrepresentative advantage."

CAP 3.41: "Marketing communications that include a comparison with an identifiable competitor must not discredit or denigrate another product, marketer, trade mark, trade name or other distinguishing mark."

UK check: price statements (CAP 3.17) and "up to" or "from" claims (CAP 3.22) must not mislead. Space-limited promotions must point to full terms (CAP 8.18). On RRPs, CAP 3.39: "Price comparisons must not mislead by falsely claiming a price advantage. Comparisons with recommended retail prices (RRPs) are likely to mislead if the RRP differs significantly from the price at which the product or service is generally sold." Eco claims on compostable cases bring in CAP section 11.

Frequently asked questions

Can a phone case ad show phones being dropped? Yes, if the drop you show is the drop you tested. In 2024 the ASA upheld a complaint about a Mous TV ad because its drop tests were from lower heights than shown and didn't check internal damage. That was a broadcast ruling; for Meta ads the equivalent CAP rules are 3.1, 3.7 and 3.11.

Can I say "MagSafe" or "military-grade" in a case ad? Only if you can prove it. No ASA ruling covers either term, so both are substantiation questions under CAP rule 3.7. MagSafe is an Apple trademark: Apple's guidelines allow referential phrases like "compatible with" only where the product genuinely is. The ASA warns a test certificate alone may not be enough.

Can I compare my case with "cheap cases"? Yes, carefully. A comparison with an unidentifiable competitor must not mislead, and its elements must not be picked to give you an unrepresentative advantage (CAP 3.37). If a rival can be identified, rules 3.32–3.36 apply: same purpose, objective and representative features, no confusion, and no denigration under rule 3.41.
